Agreement to terms
These terms govern your use of the Fluenspire application, operated by ThreePeak Group LLC, a Wyoming limited liability company ("Fluenspire", "we", "us"). By creating an account, you agree to these terms.
The service
Fluenspire is a creator growth agency platform. Brand accounts can build a profile and follow their campaigns; the commercial terms of a brand's pilot or retainer (pricing, scope, deliverables) are agreed separately in a written proposal and agreement. Creator accounts receive written offers for specific campaigns and accept or decline each one in the app; the terms for creators are below.
Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account, including offers accepted from it. Provide accurate information when creating your profile.
Disclaimers and limitation of liability
The service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Fluenspire is not liable for indirect, incidental, or consequential damages arising from use of the service.
Governing law
These terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.
Changes
We may update these terms from time to time. Continued use of the service after a change constitutes acceptance of the updated terms. A change never alters an agreement you have already signed; that only changes in writing, with your signature.

For creators
Working with Fluenspire as a creator
These terms are part of every creator agreement you sign in the app, together with the offer itself (your fee, deliverables, revisions, usage rights and pay date). If your offer says something different, your signed offer wins. How pay works in detail is on How creators earn.
Offers and your agreement
- Every offer states your fee, the deliverables, how many revisions are included, how long the brand may use your content, and when you are paid. An offer missing any of these can't be sent.
- An offer is only sent after the brand's deposit has cleared, so the money behind it is already paid in.
- You accept an offer in the app by typing your full legal name. That is your signature: it creates a creator agreement with the offer's terms and these terms, which Fluenspire then countersigns. You can download the agreement as a PDF at any time.
- You can decline any offer. There is no fee or penalty for declining.
- Your agreement is with Fluenspire (ThreePeak Group LLC, a Wyoming limited liability company), which engages you for the brand's campaign. You work as an independent creator, not as an employee of Fluenspire or the brand.
Your fixed base fee
- The base fee in your offer is fixed and doesn't depend on sales.
- It is owed once every deliverable in your offer has been approved.
- It is paid within 7 days of that approval and the brand's payment clearing. We pay you no later than 45 days after your content is approved, even if the brand pays late (we then pay from our own funds), once your tax form is verified and your payout details are on file.
Your product
- Product for the campaign is sent to you by Fluenspire, through its US receiving partner, not by the brand. You add your mailing address on your campaign page when you accept the offer.
- The product is yours to keep (unless your offer says it goes back), and you never pay for it or its postage, even if the campaign is cancelled.
Performance bonus
- When your offer includes a bonus, it is worked out on the terms the offer states: a share of Eligible Net Sales, an amount per order, or a one-off amount, up to your cap.
- Eligible Net Sales are the value of the products in orders credited to you, after discounts and refunds. Tax, shipping, and cancelled, unpaid, test, charged-back or fraud-flagged orders never count. Your tracking link comes first (a click within 30 days before the order, unless your offer states another window), then your discount code, and one order is credited to one creator at most.
- Sales are counted by calendar month and the bonus is paid on the 20th of the following month. A monthly bonus under $25.00 carries forward, except in the last month of the bonus period.
- If a customer is refunded after your bonus was paid, you never pay anything back. The refunded sales come off your next bonus instead (we call this a refund offset), and anything still left when the bonus period ends is written off.
Disclosure and claims
- Every sponsored post carries a clear disclosure that is hard to miss: the platform's own paid-partnership label where it has one, #ad or #sponsored in the caption before the "see more" cut, and in videos a sponsored mention on screen and out loud where practical.
- Share only your real experience. Make no medical or performance claims the brand can't back up (such as 'cures', 'treats', 'clinically proven' or promised results), and say only what the brief allows.
- Each draft passes our disclosure check before it can be approved, and the approval is kept on record.
Drafts, revisions and posting
- Send each draft before you post. The brand reviews it, and changes are limited to the revisions included in your offer. Anything beyond that needs your agreement.
- The brand reviews each draft within 5 business days of receiving it; a draft not answered in that time counts as approved.
- Approved work is paid in full. If the brand or Fluenspire cancels work you have already started (brief accepted and filming or a draft under way) before it is approved, you are paid a kill fee of 50% of that work's base fee. There is no kill fee if the cancellation is because you missed an agreed date or didn't deliver as agreed.
- Post only approved content, on the dates agreed. If you can't make a due date, tell your Fluenspire contact as early as you can.
- We won't ask you to delete a live post, except by mutual written agreement or for a legal or compliance reason.
Usage rights
- The brand may use your content only as your offer states: the kind of use, the platforms, and the end date.
- Paid ads run from your account (Meta Partnership Ads, TikTok Spark Ads) only when your offer includes them. You authorize them inside the platform, and you never share your password.
- When the usage period in your offer ends, the brand's right to use your content under it ends too, unless you agree in writing to extend it.
Getting paid
- We pay by Wise, in US dollars, and Fluenspire covers the transfer fee. You enter your payout details once on your dashboard.
- A tax form (W-9 in the US, W-8BEN elsewhere), uploaded on your dashboard, must be verified before you are paid. We keep it encrypted and delete it 4 years after your last payment. You are responsible for your own taxes.
- We check an uploaded tax form within 2 business days. Payments to new payout details wait 72 hours while we re-check them.
- If a payment is on hold, your dashboard says why.
